Writing for a Unanimous Court: The New Jersey Supreme Court Has Gone a Full Year With No Dissents

The New Jersey Supreme Court has gone a full year since a dissenting opinion has been issued. Sills Cummis’ Peter Verniero was asked to weigh in on this. According to Verniero, “There’s only so much that can be gleaned from the fact that the decisions thus far have been unanimous. It could mean that each decision turned on a narrow question, which generally increases the likelihood that an appellate court would be unanimous. Or it could mean that the members happened to be of like mind in deciding the term’s docket. Four-to-three decisions are as valid as unanimous ones, but unanimous decisions have a fortifying quality that draws attention.”
