Real Estate Litigation

Our real estate litigation has involved varying sophisticated issues in the landlord-tenant context, ranging from the enforcement or defense against restrictive covenants, to "go-dark" issues relating to continuous operations, construction, building-design defect disputes, land use and zoning administrative and appellate practice to amicus curiae briefs for industry organizations in their support of pro-industry legislation. Because of the deep real estate capability of the department, the Firm has developed well experienced standing teams of real estate and litigation department members, thereby avoiding the “learning curve” often associated with litigation matters when handled by litigators without prior experience in a particular real estate issue.

Representative Matters

  • Representation of tenants in their disposition/go-dark initiatives.
  • Representation of either landlords or tenants in dealing with issues involving virtually every lease clause ranging from commencement date disputes to enforcement of exit strategies.
  • Representation of various not-for-profit industry organizations in supporting, pro-industry legislation and positioning against currently existing or proposed anti-industry legislation.
  • Defense of landlords and tenants against a variety of class action based attacks involving issues ranging from gift cards to privacy.
