Our Health Care Practice Group draws upon the vast resources of the Firm’s Real Estate Group, which includes strong zoning and land use, development, landlord/tenant and real estate finance practices, among others. Over the years, we have represented hospitals, nursing homes, assisted living facilities and other health care-related institutions in connection with various “transactional” real estate matters.
We also work with many clients on renewable energy projects, which involve many real estate and leasing issues, and also an in-depth understanding of state and federal incentive and tax credit programs.

The land use group of Sills Cummis & Gross provides land use assistance to its clients in three broad categories:

Land Use Applications and Rezonings
From the start of a development project through ground-breaking, the Firm has provided counsel and hands-on assistance for countless projects, ranging from use variances for gas stations to general development plan approvals for town center projects and multi-million square foot office/research developments. Our counsel also includes legal services in connection with municipal rezonings, site plan and subdivision approvals. We also provide advice and advocacy before the numerous state and regional regulatory agencies which control development in New Jersey, including County Planning Boards, Soil Conservation Districts, the New Jersey Department of Environmental Protection, the State Historic Preservation Office, the New Jersey Department of Community Affairs and the New Jersey Department of Transportation.
Land Use Litigation
We have an active land use litigation practice which includes both defending and challenging municipal board approvals, ordinances and redevelopment area designations on behalf of private clients and challenging and defending state agency actions on behalf of private clients.
Redevelopment
We provide legal services to clients on all aspects of the redevelopment process. The Firm provides advice on “area in need” determinations, the adoption and implementation of redevelopment plans, the preparation and negotiation of redeveloper agreements, eminent domain, land assemblage and site plan approvals, and the host of federal, state and regional permits and approvals needed to make a redevelopment project a reality. We also provide legal services in connection with redevelopment-based incentive programs, including long-term tax exemptions, tax abatements, UEZ grants, Redevelopment Area Bond Financing, ERG grants and New Market Tax Credits.
