Congress Passes Legislation Creating New Evidence Rule

Commenting on Congress’ approval of legislation creating a new evidentiary rule to address disclosure of information protected by the attorney-client privilege and work-product doctrine, Jeffrey Greenbaum stated: “The new rule is a very positive step toward achieving uniformity and rationality in how the federal courts address privilege waivers, and it should reduce skyrocketing litigation costs..” He added: “In 2005, the Section’s Federal Practice Task Force had identified the need for uniformity on these issues across the Federal Courts.”
