Section Proposes Rule for Inadvertent Disclosures of Privileged Material

Jeffery J. Greenbaum was interviewed for an article in the January 2007 issue of Litigation News, a publication of the ABA Section of Litigation. The article titled “Section Proposes Rule for Inadvertent Disclosures of Privileged Material” discusses a resolution adopted by the ABA’s House of Delegates “calling on federal and state courts to establish consistent rules resolve claims of inadvertent disclosure of materials protected by the attorney-client privilege or the work product doctrine.” According to Greenbaum, former Co-Chair of the Section’s Federal Practice Task Force, “There are conflicting tests around the country and even within jurisdictions.” “Greenbaum says the task force prepared the resolution because ‘we felt lawyers should have a consistent standard to they know what rules apply.’”
