Ms. Patel's presentation will cover: (i) an overview of Stark Phase III, with a focus on practical recommendations for hospitals on how to assess whether changes are needed to existing contracts; (ii) summary of first court decision (April 2008) interpreting Stark's academic medical center exception; (iii) summary of recent $5 million hospital settlement with DOJ (May 2008) regarding alleged Stark violations; and (iv) summary of new Joint Commission standard (eff. Jan. 1, 2008) setting forth requirements for monitoring contracts by hospitals, along with practical recommendations for satisfying this new standard.
